Starting from 25.05.2018, the provisions of the General Regulation on the Protection of Personal Data no. 679/2016 of the EU, hereinafter referred to as GDPR.
This document explains when and why we collect personal data, how we use it, the conditions under which we can disclose it to others, how we store it safely and what are the rights of the data subjects, according to the law, in relation to such processing.
The purposes and conditions of personal data processing according to this notification apply to all personal data provided to S.C. FRESCOVERDE S.R.L. (hereinafter FRESCOVERDE), within the contractual or non-contractual relations with FRESCOVERDE, depending on the products and services made available by FRESCOVERDE.
Personal data represents any information regarding an identified or identifiable natural person, such as, but not limited to name, surname, e-mail address, no. phone number, data from the communicated CV, etc.

The processed data are, as the case may be, the following:

● date and place of birth, citizenship, marital status
● home address/residence
● phone, e-mail
● data regarding the professional situation, occupation, function, place of work
● study data

5. The legal basis of the processing
Your personal data, collected through this website, as well as in other situations, will be processed only if: it is necessary for the fulfillment of a legal obligation or for the conclusion or execution of a contract to which you are a party or based on a legitimate interest of FRESCOVERDE or if we have your consent.
Regarding the data collected as a result of you accessing the site, or as a result of completing the contact form in the Contact category, or as a result of submitting your CV to the Careers, available positions, internship category, for the legality of the processing we have need your express consent for the requested personal data, as well as any other information provided and completed by you, even unsolicited, to enter the FRESCOVERDE database to be processed exclusively for the purpose for which they were sent.

6. Purpose of processing
Your personal data will be processed only for specified, explicit and legitimate purposes
Regarding the data collected through this site, they will be processed to be able to respond to requests, information, notifications, orders, support requested by you, etc. through the contact form, from the Contact section, as well as to be able to process your request to participate in an internship or application for an available position, through the Careers section.
Also, each access to the site by you will be used to verify and keep a record of the number of accesses, the IP, collected through the programs Google Analytics, Google Tag Manager, Google Remarketing Code, Facebook Pixel.

We will keep your personal data for as long as is necessary for the purposes for which the data are processed in order to comply with the legal provisions.

Therefore, FRESCOVERDE will be able to periodically order the deletion of certain data/categories of data (for example, to the extent that their storage is no longer necessary for the purposes for which they were collected or to fulfill the legal obligations related to the company archive and the archiving of financial documents - supporting accounts, etc.).

9. Transmission of data
FRESCOVERDE does not transmit the entrusted personal data to other entities or persons from third countries or international organizations, but it is possible to disclose them either to authorized companies, contractors of FRESCOVERDE or to public authorities and institutions, within the European Economic Area, to achieve the purpose for which they have have been collected, to the following categories of recipients, who will then process personal data only for these purposes:
● collaborators: respectively advertising, marketing and promotion agencies: to help us deliver and analyze the effectiveness of our advertising campaigns and promotions, for example, our trusted partners who may use your personal data to offer you the services and / or products that you requested, and the service providers
● to other parties if: it is required by law or necessary to protect the rights and legal interests of FRESCOVERDE, to authorities, public institutions, courts, etc., in order to comply with the law, in case of transactions (mergers, absorptions) or other corporate activities , such as the transfer of a part of the activity, consolidation, reorganization, etc.

10. Your Rights
You have the following rights regarding your personal data:
A. The right to be informed
You have the right to obtain from us a confirmation as to whether or not personal data concerning you is being processed and, if so, access to the respective data and the following information:
1. the purposes of the processing;
2. categories of targeted data;
3. recipients or categories of recipients to whom the data has been or will be disclosed, especially recipients from third countries or international organizations;
4. where possible, the period for which the data is expected to be stored or, if this is not possible, the criteria used to establish this period;
5. the right to request from FRESCOVERDE the rectification or deletion of the data or the restriction of the processing of the data relating to the person concerned or the right to oppose the processing;
6. the right to file a complaint with a supervisory authority;
7. if the data are not collected from you, any available information regarding their source;
8. the existence (if applicable) of an automated decision-making process including the creation of profiles, as well as, at least in the respective cases, pertinent information regarding the logic used and regarding the importance and expected consequences of such processing for the data subject.
FRESCOVERDE provides upon request a copy of the personal data that are the subject of processing. If the data subject submits the application in electronic format and unless the data subject requests a different format, the information will be provided in a currently used electronic format.

B. The right to rectification
You have the right to obtain from FRESCOVERDE, without undue delay, the rectification of inaccurate personal data concerning you. Taking into account the purposes for which the data were processed, you have the right to obtain the completion of personal data that are incomplete, including by providing an additional statement.
FRESCOVERDE provides upon request a copy of the personal data that are the subject of processing. If the data subject submits the application in electronic format and unless the data subject requests a different format, the information will be provided in a currently used electronic format.

C. Right to erasure (“right to be forgotten”)
You have the right to obtain from FRESCOVERDE the deletion of your personal data, without undue delay, if there is one of the following reasons:
1. personal data are no longer necessary to fulfill the purposes for which they were collected or processed;
2. withdraw your consent on the basis of which the processing takes place and there is no other legal basis for the processing;
3. exercise, at any time, the right to opposition, for reasons related to the particular situation in which you find yourself, regarding data processing based on the legitimate interest of FRESCOVERDE, including the creation of profiles based on said processing and there are no reasons legitimate that prevail in terms of processing;
4. personal data were processed illegally;
5. personal data must be deleted to comply with a legal obligation that falls to FRESCOVERDE.
In certain situations, the law provides for certain limitations regarding the exercise of this right, for example, by way of exception, data deletion will not be possible immediately, and FRESCOVERDE can refuse data deletion, if the processing (storage) is necessary to comply with a legal obligation ( for example, activities related to FRESCOVERDE's document archive), for establishing, exercising or defending a right in court by FRESCOVERDE or for exercising the right to free expression and information.

D. The right to restriction of processing
You have the right to obtain the restriction of processing if one of the following cases applies:
1. dispute the accuracy of the data - the restriction will apply to you for a period that allows FRESCOVERDE to verify the accuracy of the data;
2. the processing is illegal, and you oppose the deletion of personal data, requesting instead the restriction of their use;
3. FRESCOVERDE no longer needs the personal data for the purpose of processing, but you request them for ascertaining, exercising or defending a right in court;
4. you objected to the processing for reasons related to the particular situation in which you find yourself, the processing based on the legitimate interest of FRESCOVERDE, including the creation of profiles based on those processings - the restriction will apply for a period that allows FRESCOVERDE to check if the legitimate rights of the operator prevail over those of the person concerned.
If the processing has been restricted according to the above, such personal data can, with the exception of storage, be processed only with your consent or for the establishment, exercise or defense of a right in court or for the protection of the rights of another natural or legal persons or for reasons of public interest.

E. The right to data portability
You have the right to receive the personal data, which concern you and which you have provided to FRESCOVERDE, in a structured format, currently used and which can be read automatically and you have the right to transmit this data to another operator, without obstacles on the part of FRESCOVERDE, if the processing is based on your consent or the need to execute a contract, and the processing is carried out by automatic means.
In exercising the right to portability, you have the right to have your personal data transmitted directly by FRESCOVERDE to another operator, where this is technically feasible.
Exercising this right does not affect the right to delete data or the rights and freedoms of others.

F. The right to opposition
At any time, you have the right to object, for reasons related to your particular situation, to the processing based on the legitimate interest of FRESCOVERDE, including the creation of profiles based on said processing. In such a case, FRESCOVERDE will no longer process the data, except in the case where it proves that it has legitimate and compelling reasons that justify the processing and that prevail over the interests, rights and freedoms of the data subject or that the purpose is to ascertain, exercise or defend a right in instance.
Moreover, in all cases where the processing is based on your consent, you have the right to withdraw your consent at any time, without being prejudiced in any way. According to the law, the withdrawal of consent will not affect the legality of the processing carried out by FRESCOVERDE before the withdrawal of consent.

G. The right not to be subject to a decision based solely on automatic processing, including profiling
In the situation where this produces legal effects against the person concerned, or affects him in an important way, with the exceptions provided by law.
H. The right not to be subject to automated individual decision-making, including profiling
As a data subject, you have the right not to be subject to a decision based solely on automatic processing, including profiling, which produces legal effects that concern or similarly affect you to a significant extent. This right does not apply if the decision:
1. is necessary for the conclusion or execution of a contract between you and FRESCOVERDE
2. is authorized by Union law or internal law that applies to FRESCOVERDE and that also provides for appropriate measures to protect your rights, freedoms and legitimate interests or
3. is based on your explicit consent.
In case you will be subject to an automated individual decision, including profiling, according to the above, you will also have the right to obtain human intervention from FRESCOVERDE, to express your point of view and to contest that decision

11. Data processing security
FRESCOVERDE processes your personal data with a full sense of responsibility, taking the necessary technical and organizational measures to ensure a level of security corresponding to the potential risks for the rights and freedoms of natural persons, to protect you against illegal or unauthorized access or use, such as and against the accidental loss or damage of data.
The security measures taken include, among others, the pseudonymization or encryption of personal data, the ability to ensure the confidentiality, integrity, continued availability and resilience of processing systems and services, the ability to restore the availability of personal data and access to it in a timely manner in the event of a physical or technical incident, a process for periodic testing, evaluation and assessment of the effectiveness of technical and organizational measures to guarantee processing security.

12. Social networks
If a FRESCOVERDE portal/website will be used a certain social network login (for example, Facebook account), FRESCOVERDE will record the personal data available as well as the history on this social network, meaning that its use represents express and unequivocal consent and the explicit agreement regarding the communication of your personal data recorded by FRESCOVERDE through its portal.
We remind you that publishing on social media sites can have certain consequences, including for your confidentiality or the people whose data you communicate, being fully responsible for what you publish, FRESCOVERDE not having any responsibility in this regard.
